1. Agreement to Terms

By accessing or using IndustrySites Pro services provided by The Mikanao Hub ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Service Description

IndustrySites Pro provides professional website development and management services, including:

• Proven-layout website design and development
• 3 business day launch guarantee, measured from receipt of all client content. The guarantee period pauses while awaiting client review or feedback.
• Website hosting and maintenance (with subscription)
• Technical support and updates
• Domain and SSL certificate management (with subscription)

3. Pricing and Payment Terms

Essential — $599 one-time + $49 per month

• 5 pages built on a proven layout for your trade
• 3 business day delivery, measured from receipt of all client content
• Initial setup and deployment
• One-time build fee is due upfront before project commencement
• Processed securely through Stripe

Complete — $1,200 one-time + $99 per month

• 10 pages, including a page for each service area
• Online booking
• Everything included in Essential
• One-time build fee is due upfront before project commencement
• Processed securely through Stripe

Monthly Care Plan ($49/month Essential, $99/month Complete)

• Includes hosting, maintenance, and updates
• 24/7 technical support
• Security monitoring and backups
• SSL certificate and domain management
• Billed monthly, automatically renewing
• Can be cancelled anytime with 30 days notice

All prices are in USD. Additional fees may apply for extra features, third-party integrations, or rush deliveries. We reserve the right to modify our pricing with 30 days notice.

4. Refund and Cancellation Policy

One-Time Payment

• Refunds available within 7 days of project delivery if deliverables do not meet agreed specifications
• No refunds after client approval of the website
• Partial refunds may be considered on a case-by-case basis

Monthly Subscription

• Cancel anytime with 30 days written notice
• No refunds for partial months
• Upon cancellation, services continue until the end of the current billing period
• Website files and data can be transferred to client upon request

5. Client Responsibilities

To ensure timely delivery and quality service, clients agree to:

• Provide all necessary content, images, and materials within 48 hours of project start
• Respond to requests for feedback and approvals within 24 hours
• Ensure all provided content is legally owned or licensed for use
• Provide accurate business information and contact details
• Maintain subscription payments for continued service access

Delays in providing materials or feedback may extend the 3 business day delivery timeline.

6. Intellectual Property Rights

Client Content

You retain all rights to content you provide (text, images, logos, etc.). You grant us a license to use this content solely for the purpose of creating and maintaining your website.

Developed Website

Upon full payment of the one-time fee, you own the website design and code we create specifically for you. However:

• We retain rights to reuse design patterns, techniques, and general approaches
• Third-party tools, libraries, and frameworks remain property of their respective owners
• We may showcase your website in our portfolio unless you request otherwise

7. Service Limitations and Warranties

Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance. We are not liable for downtime caused by third-party services, internet issues, or circumstances beyond our control.

Warranty

We warrant that services will be performed in a professional manner consistent with industry standards. We do not guarantee specific results, rankings, or business outcomes. Websites are provided "as is" after client approval.

8. Limitation of Liability

To the maximum extent permitted by law, The Mikanao Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising from your use of our services. Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless The Mikanao Hub from any claims, damages, losses, liabilities, and expenses arising from: (a) your use of our services, (b) content you provide, (c) violation of these terms, or (d) infringement of third-party rights.

10. Dispute Resolution

In the event of any dispute:

• Parties agree to first attempt resolution through good-faith negotiation
• If negotiation fails, disputes may be resolved through binding arbitration
• Arbitration shall be conducted in English
• Each party bears its own legal costs unless otherwise determined by arbitrator

11. Governing Law

These Terms shall be governed by and construed in accordance with international commercial law and principles. For clients in specific jurisdictions, local consumer protection laws may also apply.

12. Modification of Terms

We reserve the right to modify these Terms at any time. We will notify active clients of material changes via email. Continued use of our services after changes constitutes acceptance of the new terms.

13. Termination

We may terminate or suspend your account and access to services:

• For violation of these Terms
• For non-payment of subscription fees (after 15 days notice)
• For abusive or illegal use of services
• At our discretion with 30 days notice
